A non-immigrant alien is someone who is not a U.S. citizen and enters the U.S. for a limited time period for a specific reason. A non-immigrant alien may be considered inadmissible for various reasons, including health, financial, criminal, and security considerations.

What Does the I 192 Waiver Provide?

The I 192 waiver allows inadmissible non-immigrant aliens to temporarily enter the U.S, even if they have been otherwise denied.

Who is Eligible for the I 192 Waiver?

In order for non-immigrant aliens who have been denied entry to the U.S. to apply for temporary entry into the country, they must meet one of the following qualifications:

  • The non-immigrant alien possesses the necessary documents, or
  • They are an applicant for T non-immigrant status, or
  • They are an applicant for U non-immigrant status.

This waiver may be inappropriate for some non-immigrant aliens, such as those inadmissible under INA section 212(a)(3)(A)(i)(I), (A)(ii), (A)(iii), (C), (E)(i), or (E)(ii) or only under INA section 212(a)(3)(D).

For example, if you are applying for a waiver of medical inadmissibility, your statement should describe, in detail, your medical condition. You should also present any relevant medical records of your condition that can aid immigration officials in evaluating a waiver such as a letter from your doctor explaining that you would not be a danger to society.
